A. Session Fees as Per Package The session fee covers the time and talent of the photographer/s, basic retouching and creative editing of images, as determined by the photographer, and a maximum of 8 hours coverage. Additional time is available at additional expense to be determined by the photographer. All excellent images will be included in this package. Once the photos have been edited, the client will get to view/download the digitals in an online gallery that the photographer will send. B. Reservation Deposit and Payment Schedule: The client agrees to pay a non-refundable deposit fee of 30% to secure the wedding date. The full amount is to be paid to Dira 7 days before the wedding date. Upon a photoshoot location that exceeds 25km in travel, client will need to pay additional money for gas and travel time of the photographers. Upon receiving your information and the deposit, the Photographer reserves the time and date agreed upon, and will not make other reservations for that time and date. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control. In case of unforeseen circumstances, Dira will provide an alternative photographer. C. Guaranteed Delivery Photographer agrees to have the contracted order for the photo session completed within 45 DAYS. We do not want to feel rushed to complete orders shorter than this timeframe. We request that clients refrain from emailing asking when orders will be completed. D. Independent Contract This session is not to be construed as an employment agreement in any way. The Photographer functions as an independent contractor. E. Archive After three (3) months, all images will be purged from the photographer’s hard drive, except as needed for promotional purposes, to be determined by the photographer at the photographer’s sole discretion. The photographer is not responsible for loss or damage to the digital files due to circumstances beyond the photographer’s control. We highly recommend exporting these images to an additional USB or online storage. F. Damage The photographer is not responsible for the damage of portraits after delivery to the client, including damage caused during transit. The client assumes all responsibility for the safety of all portraits upon receipt. G. Model Release I hereby give to Dira Media Photography the absolute and irrevocable right and permission with respect to the photographs that he/she has taken of myself and/or my minor child in which he/she may be included with others: a) To copyright the same in the photographer’s name or any other name that he/she may select; b) To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade, and; I hereby release and discharge the photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy. H. Liability The photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographers from any claims against their person or their business. I. Copyright & Penalty Dira media Photography retains all copyrights to all images created during the client’s session. A print release will be given with digital files to print portraits for personal use only. The print release does allow publication of your portraits (i.e. entering in contests), but not selling or altering of your images without the photographer’s written permission. When uploading to social media, please be sure to credit the photographer. J. The session starts at the agreed-upon time. It is strongly encouraged that the client arrives 5 minutes prior to the start of the session. The photographers will not extend the time of session due to delays. Additional time will have to be accounted and compensated for if ceremony or reception starts later. k. This session will cover getting ready, ceremony, wedding party, bridal couple, family, and reception photos unless otherwise agreed upon. Clients will provide a list of family photos they would like with the names of family members. Clients will provide a person to gather and organize family members for photos. Photographers will be provided a meal at the reception.
